Terms of Service & Refund Policy

These Terms of Service ("Terms") govern your use of the websites and services operated by Coulson Investments LLC, operating at EnlivenApp.com, including enlivenapp.com, festevental.com, and pubvana.net. By accessing or using our services, you agree to these Terms.

All prices on our platforms are displayed in United States Dollars (USD).

Part A — Festevental (Event Listings & Ticket Sales)

A1. Service Description

Festevental (festevental.com) is an event management and ticketing platform. Organisers ("Event Organisers") can create event listings, define ticket types and prices, and receive payments from attendees ("Ticket Buyers") via Stripe Connect.

A2. Ticket Purchases

• Ticket prices are set by Event Organisers and displayed in USD before checkout.
• Payment is processed securely by Stripe at the time of purchase.
• E-tickets are delivered by email immediately upon successful payment.
• Tickets are valid as proof of entry to the event specified on the ticket. Festevental is not responsible for admission decisions made by Event Organisers.

A3. Ticket Refunds & Cancellations

• Refund eligibility is determined by the individual Event Organiser's policy, which is displayed on the event listing page.
• If an event is cancelled by the Event Organiser, Ticket Buyers are entitled to a full refund of the ticket face value.
• If an event is postponed, Ticket Buyers may request a refund within 14 days of the rescheduled date announcement.
• Booking fees and per-ticket service charges are non-refundable unless the event is cancelled.
• To request a refund, Ticket Buyers should contact the Event Organiser directly via the contact details on the event listing, or email mw@enlivenapp.com if the organiser cannot be reached.

• Platform subscription or listing fees paid by Event Organisers are non-refundable once a billing period has commenced.
• Stripe processing fees are non-refundable by Festevental; Organisers should refer to Stripe's fee policy.

A4. Organiser Responsibilities

Event Organisers are solely responsible for the accuracy of event listings, the conduct of events, compliance with local laws, and honouring commitments to Ticket Buyers. Festevental acts as a technology platform only and is not a co-organiser of any event.

Part B — Pubvana (CMS, Themes & Widgets)

B1. Free CMS Software

The core Pubvana CMS and blogging software is provided free of charge under its open-source licence. It is provided "as is" without warranty of any kind. Coulson Investments LLC is not liable for any damages arising from its use.

B2. Premium Themes & Widgets

Pubvana themes and widgets are digital products available for purchase on pubvana.net. Prices are displayed in USD before checkout. Payment is processed securely by Stripe.

• Purchases are a one-time licence fee — no recurring subscription.
• Upon payment, you receive a licence to use the theme or widget on a single Pubvana installation (unless otherwise stated on the product page).
• Download links are provided immediately after purchase via email.
• Licences are non-transferable and may not be resold or redistributed.

B2. Refund Policy for Digital Products (Themes & Widgets)

• Eligible for refund: If a theme or widget fails to install correctly or does not match the description on the product page, and our support team is unable to resolve the issue within 5 business days, you are entitled to a full refund.
• Not eligible for refund: Refunds are not available if you have simply changed your mind, if the product was purchased in error, or if the product has been used on a live Pubvana installation.
• Refund requests must be submitted within 14 days of purchase.
• To request a refund, email mw@enlivenapp.com with your order number and a description of the issue.

Part C — General Terms

C1. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorised access.

C2. Prohibited Use

You agree not to use our services to:

• Violate any applicable law or regulation.
• List fraudulent, misleading, or non-existent events.
• Engage in card testing, chargebacks abuse, or payment fraud.
• Reverse-engineer, scrape, or copy any part of our platforms.

We reserve the right to suspend or terminate accounts that violate these Terms.

C3. Limitation of Liability

To the maximum extent permitted by law, Coulson Investments LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

C4. Governing Law

These Terms are governed by the laws of the State of Vermont, United States. Any disputes shall be resolved in the courts of Vermont.

C5. Changes to These Terms

We may update these Terms at any time. The date at the top of this page reflects the most recent revision. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
